As you can see, when I'm using "Mark all files that duplicate this folder tree elsewhere" it marks just where the path is like the selection (green frame).

But I would like to have the selection made based just on the red frame! How must I do that?

Try the Selection Assistant (icon), Select By Location, & use 'H:\Creative Cloud Files\' as the location.
